Introduction

Data protection is of a particularly high priority for the management of the innomatec GmbH. It is generally possible to use the innomatec GmbH website without providing any personal data. However, if you wish to make use of special services of our company via our website, it may be necessary to process personal data.

The processing of personal data, such as the name, address, e-mail address, or telephone number of a data subject shall always be in line with the General Data Protection Regulation (GDPR), and in accordance with the country-specific data protection regulations applicable to the innomatec GmbH. By means of this data protection declaration, our company would like to inform the public about the type, scope, and purpose of the personal data we collect, use and process. Furthermore, data subjects are informed of their rights by means of this privacy policy.

As the controller, the innomatec GmbH has implemented numerous technical and organizational measures to ensure the most complete protection of personal data processed through this website. Nevertheless, Internet-based data transmissions can generally have security gaps, so that absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us by alternative means, for example by telephone.

Collection of general data and information

The website of the innomatec GmbH collects a series of general data and information when a data subject or automated system calls up the website. This general data and information are stored in the server log files. Among other things, the following can be recorded (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system accesses our website (so-called referrer), (4) the sub-websites which are accessed via an accessing system on our website, (5) the date and time of access to the website, (6) an internet protocol address (IP address), (7) the internet service provider of the accessing system and (8) other similar data and information used for security purposes in the event of attacks on our information technology systems.

When using these general data and information, the innomatec GmbH does not draw any conclusions about the data subject. Rather, this information is needed to (1) deliver the content of our website correctly, (2) optimize the content of our website as well as its advertisement, (3) ensure the long-term viability of our information technology systems and website technology, and (4) provide law enforcement authorities with the information necessary for criminal prosecution in case of a cyber-attack. Therefore, the innomatec GmbH analyzes anonymously collected data and information statistically, with the aim of increasing the data protection and data security of our enterprise, and to ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.

Planned data transfer to third countries

A transfer to third countries is currently not planned, otherwise the corresponding legal requirements will be created. In particular, you will be informed about the respective recipients or categories of recipients in accordance with the legal requirements.

Registration on our website

The data subject has the option of registering on the controller's website by providing personal data. Which personal data is transmitted to the controller is determined by the respective input mask used for registration. The personal data entered by the data subject is collected and stored exclusively for internal use by the controller and for the controller's own purposes. The controller may arrange for the data to be passed on to one or more processors, who will also use the personal data exclusively for internal use attributable to the controller.

By registering on the controller's website, the IP address assigned by the data subject's Internet service provider (ISP), the date and time of registration are also stored. This data is stored against the background that this is the only way to prevent the misuse of our services and, if necessary, to make it possible to investigate criminal offenses committed. In this respect, the storage of this data is necessary to safeguard the controller. This data is not passed on to third parties unless there is a legal obligation to pass it on or it serves the purpose of criminal prosecution.

The registration of the data subject with voluntary provision of personal data serves the controller to offer the data subject content or services which, due to the nature of the matter, can only be offered to registered users. Registered persons are free to change the personal data provided during registration at any time or to have it completely deleted from the controller's database. The entirety of the controller's employees are available to the data subject as contact persons in this context.

Subscribing to and receiving our newsletter

On the website of the innomatec GmbH, users are given the opportunity to subscribe to our enterprise's newsletter. The input mask used for this purpose determines what personal data are transmitted to the controller when the newsletter is ordered. Mandatory fields are marked accordingly.

The innomatec GmbH informs its customers and business partners regularly by means of a newsletter about enterprise offers. The newsletter of our company can only be received by the data subject if the data subject registers to receive the newsletter. For legal reasons, a confirmation e-mail is sent to the e-mail address entered by a data subject for the first time for the newsletter dispatch using the double opt-in procedure. This confirmation email is used to check whether the owner of the email address as the data subject has actually authorized the receipt of the newsletter.

When registering for the newsletter, we also store the IP address assigned by the Internet service provider (ISP) of the computer system used by the data subject at the time of registration, as well as the date and time of registration. The collection of this data is necessary in order to be able to trace the (possible) misuse of a data subject's e-mail address at a later date and therefore serves as legal protection for the controller.

The personal data collected when registering for the newsletter will be used exclusively to send our newsletter. Furthermore, subscribers to the newsletter may be informed by e-mail if this is necessary for the operation of the newsletter service or a registration in this regard, as could be the case in the event of changes to the newsletter offer or changes to the technical circumstances. The personal data collected as part of the newsletter service will not be passed on to third parties. The subscription to our newsletter can be cancelled by the data subject at any time. The consent to the storage of personal data, which the data subject has given us for the newsletter dispatch, can be revoked at any time. There is a corresponding link in every newsletter for the purpose of revoking consent. It is also possible to unsubscribe from the newsletter at any time directly on the controller's website or to inform the controller of this in another way.

HubSpot is used as the newsletter software. Your data will be transmitted to HubSpot, Inc. HubSpot is prohibited from selling your data and using it for purposes other than sending newsletters. Data processing always takes place in the EU. Data is not transferred to third countries. A corresponding contract for order processing has been concluded. You can find further information here: https://www.hubspot.de/data-privacy/privacy-shield

The newsletters of innomatec GmbH also contain so-called tracking pixels. A tracking pixel is a miniature graphic that is embedded in e-mails that are sent in HTML format to enable log file recording and log file analysis. This allows a statistical evaluation of the success or failure of online marketing campaigns to be carried out. Based on the embedded tracking pixel, the innomatec GmbH may see if and when an e-mail was opened, and which links in the e-mail were called up.

Such personal data collected via the tracking pixels contained in the newsletters are stored and evaluated by the controller in order to optimize the newsletter dispatch and to adapt the content of future newsletters even better to the interests of the data subject. This personal data is not passed on to third parties.

Data subjects are entitled at any time to revoke the separate declaration of consent given in this regard via the double opt-in procedure. After a revocation, this personal data will be deleted by the controller. The innomatec GmbH automatically regards a withdrawal from the receipt of the newsletter as a revocation.

Contact and e-mail communication

The website of the innomatec GmbH contains information that enables a quick electronic contact to our enterprise, as well as direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a data subject contacts the data controller by e-mail or via a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the controller are stored for the purposes of processing or contacting the data subject. This personal data is not passed on to third parties unless the nature of the request requires or presupposes this. We would like to point out that communication by e-mail cannot always be encrypted.

Cookies & other services

The Internet pages of the innomatec GmbH use cookies. Cookies are text files that are placed and stored on your computer via your Internet browser.

Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier for the cookie. It consists of a string of characters through which websites and servers can be assigned to the specific internet browser in which the cookie was stored. This enables the websites and servers visited to distinguish the individual browser of the data subject from other Internet browsers that contain other cookies. A specific Internet browser can be recognized and identified via the unique cookie ID.

Through the use of cookies, the innomatec GmbH can provide the users of this website with more user-friendly services that would not be possible without the cookie setting.

Cookies can also be used to optimize the information and offers on our website for the benefit of the user. As already mentioned, cookies enable us to recognize the users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to re-enter their access data each time they visit the website, as this is done by the website and the cookie stored on the user's computer system.

The data subject can prevent the setting of cookies by our website at any time by means of a corresponding setting of the Internet browser used and thus permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time via an Internet browser or other software programs. This is possible in all common Internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be fully usable.

Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyze the behavior of website visitors. The website operator receives various usage data, such as page views, length of visit, operating systems used and origin of the user. This data is summarized in a user ID and assigned to the respective end device of the website visitor.

We can also use Google Analytics to record your mouse and scroll movements and clicks, among other things. Google Analytics also uses various modeling approaches to supplement
the collected data records and uses machine learning technologies for data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analyzing user behavior (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is generally transmitted to a Google server in the USA and stored there.

The use of this service is based on your consent in accordance with Art. 6 para. 1 lit. a GDPR and §25 para. 1 TTDSG. Consent can be revoked at any time.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. You can find details here:
https://privacy.google.com/businesses/controllerterms/mccs/.

IP anonymization

We have activated the IP anonymization function on this website. This means that your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. Google will use this information on behalf of the operator of this website for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

Browser plugin

You can prevent the collection and processing of your data by Google in advance by downloading and installing the browser plug-in available at the following link:
https://tools.google.com/dlpage/gaoptout?hl=de .

You can find more information on how Google Analytics handles user data in
Google's privacy policy:
https://support.google.com/analytics/answer/6004245?hl=de.

Google signals

We use Google signals. When you visit our website, Google Analytics records your
location, search history and YouTube history as well as demographic data (visitor data), among other things.

This data can be used for personalized advertising with the help of Google Signal. If you have a Google account, the visitor data from Google Signal is linked to your Google account and used for personalized advertising messages. The data is also used to compile anonymous statistics on the user behavior of our users.

Demographic characteristics in Google Analytics

This website uses the "demographic characteristics" function of Google Analytics to display suitable advertisements to website visitors within the Google advertising network. This allows reports to be generated that contain statements about the age, gender, and interests of site visitors. This data comes from interest-based advertising from Google and from visitor data from third-party providers. This data cannot be assigned to a specific person. You can deactivate this function at any time via the ad settings in your Google account or generally prohibit the collection of your data by Google Analytics as described in the section "Objection to data collection".

Order processing

We have concluded an order processing contract with Google and fully implement the strict
requirements of the German data protection authorities when using Google Analytics.

Google Tag Manager

We use the Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that allows us to integrate tracking or statistical tools and other technologies on our website. The Google Tag Manager itself does not create any user profiles, does not store any cookies and does not carry out any independent analyses. It is only used to manage and display the tools integrated via it. However, Google Tag Manager records your IP address, which may also be transmitted to Google's parent company in the United States.

The Google Tag Manager is used on the basis of Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the fast and uncomplicated integration and management of various tools on its website. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time.

Hubspot CRM

We use Hubspot CRM on this website. The provider is Hubspot Inc. 25 Street, Cambridge, MA 02141 USA (hereinafter Hubspot CRM).

Among other things, Hubspot CRM enables us to manage existing and potential customers and customer contacts. With the help of Hubspot CRM, we are able to record, sort and analyze customer interactions via email, social media or telephone across various channels. The personal data collected in this way can be evaluated and used for communication with the potential customer or for marketing measures (e.g. newsletter mailings). With Hubspot CRM, we are also able to record and analyze the user behavior of our contacts on our website.

The use of Hubspot CRM is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the most efficient customer management and customer communication possible.

Details can be found in Hubspot's privacy policy:

YouTube with extended data protection mode

This website embeds videos from the YouTube website. The operator of the pages is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in extended data protection mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. However, the transfer of data to YouTube partners is not necessarily excluded by the extended data protection mode. For example, YouTube establishes a connection to the Google DoubleClick network regardless of whether you watch a video.

As soon as you start a YouTube video on this website, a connection to the YouTube servers is established. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, YouTube may store various cookies on your end device after starting a video or use comparable recognition technologies (e.g. device fingerprinting). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to record video statistics, improve user-friendliness and prevent fraud attempts.

After the start of a YouTube video, further data processing operations may be triggered over which we have no influence.

The use of YouTube is in the interest of an appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

You can find more information about data protection at YouTube in their privacy policy at: https://policies.google.com/privacy?hl=de.

Google Maps

This site uses the map service Google Maps. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

To use the functions of Google Maps, it is necessary to save your IP address. This information is usually transmitted to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer. If Google Maps is activated, Google may use Google Fonts for the purpose of uniform display of fonts. When you call up Google Maps, your browser loads the required web fonts into your browser cache in order to display texts and fonts correctly.

The use of Google Maps is in the interest of an appealing presentation of our online offers and to make it easy to find the places we have indicated on the website. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission.
Details can be found here:

https://privacy.google.com/businesses/gdprcontrollerterms/sccs/.

You can find more information on the handling of user data in Google's privacy policy: https://policies.google.com/privacy?hl=de.

Google reCAPTCHA

We use "Google reCAPTCHA" (hereinafter "reCAPTCHA") on this website. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

The purpose of reCAPTCHA is to check whether data is entered on this website (e.g. in a
contact form) by a human or by an automated program. For this purpose,
reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This
analysis begins automatically as soon as the website visitor enters the website. For the analysis,
reCAPTCHA evaluates various information (e.g. IP address, time spent on the website by the website visitor or mouse movements made by the user). The data collected during the analysis is forwarded
to Google.

The reCAPTCHA analyses run completely in the background. Website visitors are not informed
that an analysis is taking place.

The data is stored and analyzed on the basis of Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its website from abusive automated spying and SPAM.

For more information about Google reCAPTCHA, please refer to the Google Privacy Policy and the Google Terms of Service at the following links:
https://policies.google.com/privacy?hl=de and

Routine deletion and blocking of personal data

The controller shall process and store the personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is granted by the European legislator or other legislators in laws or regulations to which the controller is subject to.

If the storage purpose no longer applies or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data will be routinely blocked or deleted in accordance with the statutory provisions.

Rights of the data subject

Right to information
You have the right to receive information from us at any time upon request about the personal data processed by us concerning you within the scope of Art. 15 GDPR. To do so, you can send a request by post or email to the addresses given above.

Right to rectification of inaccurate data
You have the right to obtain from us without undue delay the rectification of inaccurate personal data concerning you (Art. 16 GDPR). To do so, please use the contact addresses given above.

Right to erasure
You have the right to the immediate erasure ("right to be forgotten") of personal data concerning you if the legal grounds pursuant to Art. 17 GDPR apply. These exist, for example, if the personal data are no longer necessary for the purposes for which they were originally processed or if you have withdrawn your consent and if there is no other legal basis for the processing; the data subject objects to the processing (and there are no overriding reasons for processing - this does not apply to objections to direct marketing). To exercise your above right, please contact us at the addresses given above.

Right to restriction of processing
You have a right to restriction of processing if the conditions are met and in accordance with Art. 18 GDPR. According to this, the restriction of processing may be required in particular if the processing is unlawful and the data subject refuses to delete the personal data and instead requests the restriction of the use of the personal data or the data subject has objected to the processing pursuant to Art. 21 para. 1 GDPR, as long as it is not yet clear whether our legitimate reasons outweigh theirs. To assert your aforementioned right, please contact us at the contact addresses given above.

Right to data portability
You have a right to data portability in accordance with Art. 20 GDPR. You have the right to receive the data concerning you, which you have provided to us, in a commonly used, structured and machine-readable format and to transmit those data to another controller, such as another service provider. The prerequisite for this is that the processing is based on consent or on a contract and is carried out using automated procedures. To assert your above right, please contact us at the addresses given above.

Right to object
You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based, inter alia, on point (e) or (f) of Article 6(1) GDPR pursuant to Article 21 GDPR. We will stop processing your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims. To assert your aforementioned right, please contact us at the addresses given above.

Right to revoke consents granted

Any person affected by the processing of personal data has the right granted by the European legislator of directives and regulations to withdraw consent to the processing of personal data at any time.

Right to lodge a complaint with a supervisory authority
If you believe that the processing of personal data concerning you by us is unlawful, you have the right to lodge a complaint with a supervisory authority. The supervisory authority is responsible for us:

The Hessian Data Protection Officer
P.O. Box 31 63
65021 Wiesbaden
Phone: +49 611 1408-0
E-mail: poststelle@datenschutz.hessen.de

To assert one or more of your rights, please contact the above-mentioned controller or the data protection officer.

We offer you the opportunity to apply to us (e.g. by e-mail, post or via the online application form). In the following, we inform you about the scope, purpose and use of your personal data collected as part of the application process. We assure you that your data will be collected, processed and used in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

If you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during job interviews, etc.) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b GDPR (general contract initiation) and - if you have given your consent - Art. 6 para. 1 lit. a GDPR. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons who are involved in processing your application.

If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6 para. 1 lit. b GDPR for the purpose of implementing the employment relationship.

Data retention period

If you reject a job offer or withdraw your application, your data will be deleted immediately. In the event of a rejection on our part, we reserve the right to retain the data transmitted by you on the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months from the end of the application process. The data will then be deleted and the physical application documents destroyed. The retention serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g. due to an impending or pending legal dispute), the data will only be deleted when the purpose for further storage no longer applies.

Data may also be stored for longer if you have given your consent (Art. 6 para. 1 lit. a GDPR) or if statutory retention obligations prevent deletion.

Inclusion in the applicant pool

If we do not make you a job offer, you may have the opportunity to be included in our applicant pool. If you are accepted, all documents and details from your application will be transferred to the applicant pool so that you can be contacted in the event of suitable vacancies.

Inclusion in the applicant pool is based exclusively on your express
consent (Art. 6 para. 1 lit. a GDPR). Giving consent is voluntary and is not related to the current application process. The data subject can withdraw their consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, provided there are no legal grounds for retention.

The data from the applicant pool will be
irrevocably deleted no later than two years after consent has been granted.

General legal basis for processing

Art. 6 I lit. a GDPR serves our company as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, when processing operations are necessary for the supply of goods or to provide any other service or consideration, the processing is based on Art. 6 I lit. b GDPR. The same applies to such processing operations that are necessary to carry out pre-contractual measures, for example in cases of inquiries about our products or services. If our company is subject to a legal obligation which requires the processing of personal data, such as for the fulfillment of tax obligations, the processing is based on Art. 6 I lit. c GDPR. Ultimately, processing operations could be based on Art. 6 I lit. f GDPR. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to safeguard a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject do not prevail.

Legal or contractual provisions for the provision of personal data; necessity for the conclusion of the contract; obligation of the data subject to provide the personal data; possible consequences of non-provision

We inform you that the provision of personal data in cooperation with us is partly required by law (e.g. tax regulations) or may also result from contractual provisions (e.g. information on the contractual partner). Sometimes it may be necessary for a contract to be concluded for a data subject to provide us with personal data that must subsequently be processed by us. For example, the data subject is obliged to provide us with personal data if our company concludes a contract with them. Failure to provide the personal data would mean that the contract with the data subject could not be concluded or fulfilled.

On request, our employees will also inform the data subject on a case-by-case basis whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and what the consequences would be if the personal data were not provided.

Existence of automated decision-making

As a responsible company, we do not use automated decision-making or profiling.
